The following are the general terms and conditions that apply to all booking and payment procedures for the dive packages and Scuba courses offered by Marine Monkees.
Confirming Your Intention to Purchase - Dive Package/Scuba Course
When you have decide upon your desired dive package or Scuba course, you will then have to confirm by either:
- Online Web Form
- You can send in your intention of purchase by filling up the Dive package/ Scuba course web booking form.
- Email
- You can send an email to manager@marinemonkees.com indicating your intention to purchase a particular dive package/ Scuba course.
Please ensure that you send us all necessary details and clearly indicate your option/’s.
Booking Confirmation
When we receive your booking form, we will send you an email with your Booking Notification and instruction on how to make payment or a Reservation Deposit.
Reservation Deposit
A Reservation Deposit is to guarantee your reservation. A non-refundable deposit of 30% of total booking price is required.
Confirmation of Reservation.
When we received your Reservation Deposit, we shall then proceed to make the necessary bookings. When your reservation is confirmed by the respective operators, we will send you a Confirmation of Reservation.
How a contract is made
Please note general contract for any on-line for purchase of retail product are different from the dive packages/ Scuba courses purchased through Marine Monkees.
We act as an agent for third party supplier, such as PADI centers, live aboard operators and/or other dive operators, hotels and resorts. Therefore, we gather all information from these operators and present them to you through our website. We will do our best to verify and update this information constantly. Since we act as an agent, we do not have a contractual liability to you with respect to outcome of the trip. However, we will be liable to you if at any point we have been negligent or misrepresented important information.
The contract for the dive package is between you and the respective operator. Generally, there are additional terms and conditions governing the contract as each operator will have their own terms and conditions relating to their dive packages. Please ensure you have read the terms and conditions before completing your transaction with us. You can easily request them from us by emailing us at manager@marinemonkees.com.
Once payment is received, you can cancel the diving package/ Scuba course in accordance to our terms and conditions. It is your duty to ensure you are familiar with any cancellation charges relevant to your booking. You make your final payment of your dive package (normally the remaining 70%) to us not more than 60 days before the trip date. We will keep you informed, by email, of the final payment amount and due date. Failure to pay your balance payment prior to the due date will be considered as a cancellation and any deposit paid will be forfeited.
All bank transfer charges are to be borne by the remitter.

Please send us a fax copy or email scanned copy of the remittance, which includes the transaction reference number.
Cancelling Your Booking.
In the event you need to cancel your reservation 60 days or more prior to your dive package commencement date. Please inform us by sending your cancellation request by email to manager@marinemonkees.com. We will proceed to return your payment less the deposit and any bank charges incurred by us.
If your cancellation comes to us less than 60 days prior to your dive package commencement date, we then reserve the right to keep the payments as compensation for potential lost bookings.
Changes to Your Booking.
If you decide to change your booking after you have made your reservation, we will do our level best to accommodate your request with no guarantees. You should notify us as soon as possible of any changes. There will be an administration fee of RM$ 100 for any booking changes which require the re-issuance of a new Reservation or invoice including, but not limited to, changes in dates, room type and diving program.
Marine Monkees reserve the right to make changes for dive package and scuba courses without prior notice. It is your responsibility to look for the changes on our website. Email and Facebook messages will be sent out with regards to these changes, it is your responsibility to check these changes periodically.
Political Unrest.
If there is any political unrest, military conflict, flight cancellations, or any other risk to customers, Marine Monkees has the right to cancel these trips without further explanation.
We will try to re-route your dive package to another destination at no extra cost within our limits. If we successfully manage to re-route the dive package to a different location, you will have to accept the new package and will not be able to cancel your dive package, and we will therefore not be able to authorize any refund .
Liability Release and Assumption of Risk
Marine Monkees will not be held liable for and will not be responsible for personal injuries, property damage, or wrongful death that may occur during activities, as a result of the inherent risks associated with scuba diving or as a result of acts or omissions of other third parties.
Diving requires a certification from a recognized dive agency such as PADI. It is your responsibility that you obtain these qualifications, and provide proof of such qualification upon request prior to you taking part in any diving activities. The only exception would be the PADI Open Water Diver or Scuba Diver Course, or Discover Scuba Diving activities that allow participants to take part without a license.
